1. Purpose and scope

This Legal Notice governs access to and use of the website, without prejudice to certain services or features that may be subject to specific terms and conditions (for example, sales, returns, shipping or warranty policies) and to the Privacy Policy and the Cookies Policy.

The service is aimed primarily at consumers in the European Union; the country of origin and main market is Spain.

2. Conditions for access to and use of the site

Users undertake to use the site, its content and services in accordance with the law, good faith, generally accepted practices and this Legal Notice. The following actions are prohibited, by way of example and without limitation:

  • Introducing or spreading viruses, malware or any other physical or logical systems liable to cause damage to the site.
  • Attempting to access, use and/or manipulate data belonging to the owner, third-party providers or other users.
  • Scraping, systematic extraction of data or content, the use of bots or similar techniques without express prior written authorisation.
  • Reproducing, distributing, transforming or publicly communicating site content for commercial purposes without prior authorisation (see Intellectual and Industrial Property).
  • Using the site for unlawful purposes, in ways that infringe rights, or that may hinder the normal operation of the service.

We reserve the right to suspend or deny access to those who breach these rules.

3. Links and framing

  • Incoming links (linking): linking to this site from third-party pages for commercial or branding purposes is not permitted without prior written authorisation. Any link must in all cases lead to the home page or complete pages, be clear and truthful, and not create confusion or take unfair advantage of Garmon Yarns’ reputation.
  • Framing/embedding/iframes: not permitted without prior written authorisation.
  • Outbound links: The site may include links to third-party sites (for example, carriers, payment platforms or social media). We have no control over their content or policies and accept no liability for them. Access is at your own risk and subject to the conditions of those third parties.

4. Intellectual and industrial property

Unless otherwise indicated, the texts on the site have been originally drafted by the owner with support from AI tools; and the graphic materials (photographs, creatives or illustrations) come from:

  • Own creations and/or materials generated with AI tools under a valid licence to use.
  • Materials supplied by suppliers and manufacturers with permission to use.
  • Free resources from freepik.es or other libraries, in accordance with their applicable licences; where relevant, adaptations or modifications have been made.

Third-party trademarks and logos (e.g., brands of products sold) are shown exclusively to identify products and comply with the relevant authorisations or limits of use. All rights over distinctive signs belong to their respective owners.

User rights over site content: downloading, copying or printing is authorised for strictly personal and private use. Any other use is prohibited, especially for commercial purposes, including reproduction, distribution, public communication, making available, transformation or exploitation of the content without the owner’s prior written authorisation.

5. User-generated content (UGC) and reviews

UGC (User Generated Content) refers to content that users may upload or publish, such as reviews, ratings, comments and images (feature enabled via the Judge.me app).

  • By publishing UGC (including photographs), you declare that you own the rights or hold the necessary permissions and that the content is not unlawful, defamatory or misleading, and does not infringe third-party rights (including intellectual property, image rights or data protection).
  • Basic rules: do not include third parties’ personal data, identifiable minors, offensive, violent, hateful or discriminatory content, advertising, or content that infringes third-party trademarks except where legitimately permitted.
  • You grant Garmon Yarns a non-exclusive, worldwide, royalty-free, sublicensable licence to host, reproduce, distribute and communicate such content within the site and our own channels for purposes related to the service and sale of products (for example, displaying reviews on product pages and in shop communications), for as long as the content remains published or until you request its removal where legally appropriate.
  • We reserve the right to moderate, hide or remove UGC that breaches these rules or the law.

6. Commercial information, availability and pricing

Prices shown on the website are, as a rule, inclusive of VAT. Before completing the purchase, the customer will see the final shipping cost, which may vary depending on the products in the basket, the delivery address, the delivery method and the integrated carriers’ dynamic rates. There are free-shipping threshold(s) for certain areas (currently Spain and Portugal); the specific conditions are set out in the Shipping Policy.

Product information, availability and prices may be updated without prior notice to reflect catalogue changes, logistics conditions or error corrections. In the event of a manifest discrepancy, we reserve the right to cancel affected orders with a full refund.

Commercial communications by email or SMS will only be sent where there is prior consent in line with the Privacy Policy; you may unsubscribe at any time by simple and free means.

7. Liability and warranties

We make reasonable efforts to keep the site secure, available and up to date. However, we cannot guarantee the absence of technical errors, service interruptions, complete accuracy of content, or the absence of harmful elements introduced by third parties. Likewise, content, images, technical descriptions, specifications, availability and prices may contain typos or omissions or may not be promptly updated. We reserve the right to correct, update or rectify any information at any time and without prior notice; if a correction affects an order already placed, we will act as indicated in section 6 (including cancellation and refund in the event of a manifest error), without prejudice to consumers’ non-waivable rights.

To the extent permitted by law, we shall not be liable for damages arising from:

  • Failures or interruptions in the operation of the site due to causes beyond our reasonable control.
  • Third-party links or content.
  • Use of the site contrary to this Legal Notice.
  • Errors or omissions in content (including product pages), colour variations due to on-screen display, and typographical or arithmetic mistakes in prices or other information, provided they are corrected in good faith as indicated.

None of the above excludes or limits liability in cases where the law does not allow it (for example, wilful misconduct or gross negligence), nor does it limit the warranties and non-waivable rights that consumer law grants you.

8. Applicable law, jurisdiction and dispute resolution

This Legal Notice is governed by Spanish law. For consumers (B2C) within the EU, the courts of the consumer’s domicile shall have jurisdiction in accordance with consumer protection rules. For B2B relations or non-consumer users, the parties submit to the Courts of Alcalá de Henares (Madrid).

At present, Garmon Yarns is not affiliated with any specific consumer arbitration system. If this changes, this Legal Notice will be updated.

10. Technical means, platform and providers

The shop is hosted and operated on the Shopify platform, on infrastructure with data centres in the European Union according to the available configuration.

By way of information (non-exhaustive), we work with third parties necessary for the provision of the service, such as:

  • Shopify (platform, hosting and shop functionality).
  • Emailing: Shopify Email (and domain mail accounts hosted at DonDominio.com).
  • Logistics/shipping: Packlink Pro and carriers (Correos, Correos Express, SEUR, InPost/Mondial Relay), to whom only the data strictly necessary for shipping are communicated.
  • Reviews: Judge.me.
  • Cookie/privacy consent: Consentmo GDPR.
  • Google tools (Analytics, Ads, Search Console, Tag Manager).
  • Advisory firm: Domo Gestión (tax and accounting obligations).

11. Marketplace and external channels

At the time of publication we do not operate as a marketplace. If external sales or product display channels are integrated in the future, the conditions of those third parties will apply, without prejudice to this Legal Notice and our internal policies.

12. Changes to the Legal Notice

Garmon Yarns may amend this Legal Notice when necessary due to regulatory, technical or business changes. The current version will be the one published on this page and will indicate the date of the latest update.
