Terms and conditions of purchase

Effective date: 23/09/2025

This document governs B2C contracts concluded through the Garmon Yarns website for deliveries within the European Union. It does not govern use of the site (browsing, accounts or content), which is governed by the Terms of Use.

1) Purpose, parties and capacity to contract

These Conditions govern distance B2C contracting of tangible goods offered by Garmon Yarns —mainly yarns, threads, accessories, tools and other items for needlework and crafts— with delivery to the areas indicated in clause 12. On an ancillary basis, they also cover the download of patterns or other digital content and the sale of customised or cut-to-size products, with the particularities set out in these Conditions.

For legal purposes, the customer is a consumer (a natural person acting for purposes outside their trade, business, craft or profession). Purchases for resale or professional use are excluded, unless agreed beforehand in writing.

By confirming the order, the customer declares that the data provided are truthful and complete and that they have sufficient legal capacity to contract. Contracting is aimed at persons aged 18 or over; as the products are not age-restricted, no specific age verification is required in the purchase flow. If the customer acts on behalf of a third party, they warrant that they have sufficient authorisation and assume the obligations arising from the order.

2) Acceptance, contract languages and copy on a durable medium

2.1 Language and versions. The contract is concluded exclusively in Spanish. If translations are offered in the future, the Spanish version will prevail in the event of discrepancy. After-sales communications will be in Spanish, unless individually agreed otherwise.
2.2 Formation of the contract and acceptance. By completing checkout and activating the payment action, you make an offer to purchase. The contract is concluded when we validate the payment and display the order confirmation on screen and/or send you the confirmation email, from which point these Conditions apply (without prejudice to the anti-fraud and availability checks provided for in these Conditions). Before confirming payment you may identify and correct errors in your order details.
2.3 Copy on a durable medium and retention. We do not generate an individual file with a “frozen” version of these Conditions for each order. The current version is published and updated on this page and we indicate its last updated date. After confirming your purchase, you will receive a confirmation email with an order summary (items, total price, taxes and shipping costs, delivery address and payment method) and a permanent link to these Conditions, which constitutes a durable medium. We recommend that you save or print a copy of the Conditions in force at the time of your order. Changes do not have retroactive effect on orders already confirmed.

3) Pre-contractual information and purchase process

Before contracting, we will make available to you, in a clear and comprehensible manner, all relevant pre-contractual information: trader identity, essential characteristics and availability of the products, total price including taxes, breakdown of shipping costs and, where applicable, surcharges or limitations, promotions or coupons applied and their conditions, available payment methods (including strong customer authentication where applicable), delivery options with their costs and estimated timeframes, the existence of the right of withdrawal with reference to its procedure and exceptions, legal guarantee and after-sales, and any other specific condition indicated on the product page or at checkout.

The purchase process generally consists of: (i) selecting items and quantities; (ii) reviewing the basket with a summary of prices and taxes; (iii) customer identification (with account or guest checkout); (iv) entering delivery and billing details; (v) calculation and selection of the shipping method; (vi) selection of the payment method and, where applicable, authentication; (vii) final order review with the ability to correct errors (products, quantities, addresses, coupons, shipping and payment) before confirming; and (viii) order confirmation by performing the payment action, after which the confirmation is shown on screen and a confirmation email is sent with the order number and purchase summary. If the order includes digital content with immediate performance, your express consent and acknowledgement of the loss of the right of withdrawal will be requested to allow the download once payment is confirmed.

Keep the order number for future queries. If you spot an error after confirming, contact us immediately so we can try to correct it before dispatch. We may carry out automatic or manual anti-fraud and availability checks; if issues arise, we will inform you and propose reasonable alternatives (waiting, exchange or refund).

4) Availability, items on back-order and pre-orders

We work with our own stock. For certain references we offer items on back-order (procured from the supplier after your purchase) and pre-orders (items not yet available). The product page and/or checkout will indicate the status and the estimated availability or procurement timeframe.

If due to a stock-out or synchronisation error a product is unavailable after payment, we will inform you without undue delay and you may choose to: (i) wait for the new timeframe; (ii) switch to another item of equivalent value (paying/receiving the difference if applicable); or (iii) terminate the contract with a full refund to the same means of payment.

Items on back-order (not customised). Procurement is carried out specifically for your order; dates are estimates based on supplier confirmation. You may request cancellation before we begin procurement; once initiated, cancellation may not be possible before dispatch for logistical reasons, without prejudice to your right of withdrawal after delivery where legally applicable and no exception applies.

Pre-order. The charge is made upon confirming the purchase. Launch or delivery dates are estimated by the manufacturer/supplier and may vary; if the launch is significantly delayed or the supplier fails to deliver, you may keep the reservation or cancel with a full refund.

Mixed orders (in-stock + back-order/pre-order). As a general rule, we group the order into a single shipment when all items are available. At our discretion, we may split the shipment at no extra cost to bring forward delivery of in-stock items. If you prefer separate shipments on request, additional costs may apply.

Supplier issues and discontinuations. If the supplier confirms that supply is impossible (e.g. discontinued product), we will propose alternatives; if you are not interested, we will proceed with a full refund.

Items on back-order not customised: these retain the consumer’s legal rights, including the right of withdrawal where applicable.
Customised or cut-to-size products: see clause 13 (withdrawal exceptions).

5) Prices, taxes, currency and country-based differences

Prices are shown in euros (€) and include VAT in accordance with current regulations and the rate applicable in the destination country within the EU at the time of purchase. Before paying, checkout will display the total amount broken down (taxable base, taxes, discounts applied and shipping costs). If the payment method operates in another currency, your provider may apply currency exchange and fees outside Garmon Yarns’ control.

We may run campaigns, promotions or differentiate prices by country (e.g. due to VAT rates, logistics costs or commercial actions), but we do not personalise prices on an individual profile basis. Save in the case of an obvious publishing error, price changes do not affect orders already confirmed. In the event of a discrepancy between a price seen on listings or cached versions and the price shown at checkout, the checkout price prevails, as it reflects all items and updates (standard rounding under tax rules may apply).

6) Strikethrough prices and promotions

Where a reduced price is shown, the “previous price” will, as a general rule, correspond to the lowest price applied by Garmon Yarns in the 30 days prior to the reduction for that same item and variant. In campaigns with staggered reductions (e.g. from −10% to −20% on successive days), we may show as a reference the price immediately prior to the first discount or the lowest price in the 30-day period, as appropriate and without misleading.

For new items with less than 30 days since first being offered for sale, the “previous price” will refer to the period elapsed since that first offering. If there is not sufficient price history, no strikethrough price will be displayed.

Unless stated otherwise, coupons, loyalty discounts, multi-buy offers (2×1, 3×2), packs/bundles and promotions applied in the basket do not constitute a “reduced price” for “previous price” purposes; their application and compatibilities are governed by their specific terms.

Where we indicate “up to −X%” or “from”, the percentage or final price may vary by colour, size, variant or available stock. All promotions are temporary, not cumulative unless expressly indicated, and valid while stocks last.

If an RRP recommended by the manufacturer is shown, it will be identified as such and will not be used as the “previous price”. The strikethrough price always refers to prices applied by Garmon Yarns in accordance with price information regulations.

7) Coupons, vouchers and compatibilities

Coupons or vouchers must be entered at checkout before confirming payment. Unless expressly stated in their specific terms, they are personal and non-transferable, single-use, valid only for online purchases on garmonyarns.com within their validity period, and are not cumulative with each other or with other promotions. They are not redeemable for cash, do not generate credit and do not entitle the holder to change when their amount exceeds the order value and, unless otherwise indicated, do not apply to gift cards, shipping costs or taxes.

If a coupon requires a minimum purchase amount, is limited to certain countries or categories/collections, or sets a discount cap, such conditions will be displayed alongside the code. If used in a way that does not meet the requirements, the system will prevent its application or the order may be cancelled with a refund of the amount paid.

Returns and cancellations: (i) if you use a fixed-amount coupon, the refund will cover only what was actually paid and the coupon will be deemed used; (ii) if the coupon is percentage-based, the refund will be calculated on the amount actually paid; (iii) coupons are not reissued or reactivated save where the error is attributable to Garmon Yarns. For partial returns, the discount will be apportioned across the items kept.

Order of application: first gift card (if applicable), then coupon/voucher, then Stitches (Points programme) and, lastly, the remaining charge to the chosen payment method. Garmon Yarns may void a coupon in the event of fraud, improper use, unauthorised public sharing or an obvious technical error.

8) Loyalty programme

Under loyalty programe, promotional Stitches are awarded: they are not money, have no monetary value, are non-transferable and are not redeemable for cash. They are generally earned at a rate of 10 Stitches for every €1 actually paid on the value of products (after applying coupons/vouchers and, unless stated otherwise, excluding shipping costs, taxes and purchase of gift cards). Stitches are credited when the order is marked as paid/confirmed in the system; if the order is cancelled or does not pass checks, they will not be credited.

Redemption takes place at checkout in multiples of 2000 Stitches = €10 discount, applied in accordance with the order indicated in clause 7 (first gift card, then coupon/voucher and, thereafter, Stitches). The Stitches discount applies to the value of products and may be incompatible with certain promotions or collections, which will be indicated in each campaign.

Expiry: Stitches expire 12 months after being earned if not redeemed; the oldest expire first. In full or partial returns and cancellations, earned and/or redeemed Stitches will be recalculated; we may deduct from the refund the equivalent of the Stitches already used on that order or subtract it from your account balance. In the event of fraud, programme abuse or an obvious technical error, we may adjust, suspend or cancel the affected Stitches balance.

9) Gift cards

Digital gift cards issued by Garmon Yarns for exclusive use on garmonyarns.com. Validity: 6 months from purchase. Non-refundable, non-reloadable and not usable to purchase other gift cards.

They are delivered by email with a bearer code: keep it in a safe place; anyone who knows it will be able to use it. The balance can be used in one or more purchases until it is exhausted or until expiry; it does not generate interest. If the order amount is less than the balance, the remainder will be available for future purchases; if greater, you may combine it with other payment methods (see the order in clause 7).

In returns or cancellations, the portion paid with a gift card is refunded to the same gift card (or, if not possible, to a new card), keeping the original expiry date. Garmon Yarns will not be liable for loss, theft or unauthorised use of the code once delivered; we may block or replace a card if it has not yet been used and you provide sufficient data to identify it.

Gift cards may only be used on garmonyarns.com, in euros, and are not redeemable for cash except as required by law. You can check the balance by contacting info[arroba]garmonyarns.com.

10) Payment methods, authentication and anti-fraud

The accepted payment methods are processed via Shopify Payments (Shopify’s payment service provider) and/or equivalent integrated gateways. This system performs tokenisation and secure processing of transactions; Garmon Yarns does not access or store your full card details.

Depending on the method chosen, we may require strong customer authentication (SCA/3-D Secure) and carry out automatic or manual anti-fraud checks before accepting the order. Unless indicated otherwise at checkout, the charge is made when the order is confirmed; in certain cases your card issuer may show pre-authorisations or temporary holds.

If a high risk of fraud or non-payment is detected, we may cancel the transaction and refund the amount via the same means. See details and particular conditions for each method on our Payment Methods page: https://www.garmonyarns.com/pages/metodos-de-pago

Anti-fraud checks may rely on risk and reputation signals provided by Shopify at a platform level (see the Privacy Policy and Shopify’s Consumer Privacy Policy/portal).

11) Invoicing

We issue invoices in accordance with applicable regulations. The invoice is generated and sent automatically when the order is placed and is also available from the order confirmation page; it can be re-sent from the Orders panel. To ensure the trader’s NIF/VAT (and, where applicable, the customer’s) appears correctly, we keep our VAT records up to date in Shopify.

If you prefer, we can issue payment requests / pro-forma invoices via draft orders (invoice with a link to checkout) before payment. For returns or refunds, we will issue the relevant corrective document / credit note and process the refund via the same means, where applicable. The tax breakdown is shown at checkout and is also included on the generated invoices.

12) Shipping, delivery areas and estimated timeframes

Delivery areas: mainland Spain, Balearic Islands, mainland Portugal, France and the rest of the European Union, except Ireland. We do not deliver to other islands or territories with special customs regimes (e.g. Canary Islands, Ceuta, Melilla, Madeira, Azores or Corsica).

Indicative timeframes (not guaranteed): 24–48 h in mainland Spain/Portugal; 48–72 h Balearic Islands; 3–5 days France; 3–7 days rest of EU. Timeframes are counted in working days and may vary due to volume, campaigns or logistical incidents. The delivery timeframe is counted from dispatch (leaving the warehouse), not from the order date. Shipping cost is shown at checkout.

Preparation and dispatch: orders are usually prepared and dispatched within 24–48 working hours from payment confirmation. During periods of high demand or promotional campaigns this timeframe may be extended. Orders including back-order or pre-order items are governed by clause 4 and may be dispatched when everything is available (unless, at our discretion, we split the shipment).

Tracking and delivery options: you will receive an email with a tracking number when the order has been dispatched. Delivery will be made to your address and/or a collection point depending on the carrier’s options. Identification and/or a signature may be requested upon delivery.

Delivery attempts and re-shipments: if delivery fails due to absence or an incorrect address, the carrier will make a new attempt or make the shipment available at a collection point. The retention period at the collection point depends on the carrier (usually between 7 and 10 days). Re-shipments or address changes requested by the customer may incur additional costs and delays. If the parcel is returned due to non-collection or an incorrect address attributable to the customer, we may re-ship it after payment of the new shipping costs or cancel the order with a refund of the amount paid minus the initial shipping costs and, if any, the return costs charged by the carrier (without prejudice to your legal rights).

Address changes: it is the customer’s responsibility to provide a correct and complete address. Once dispatched, it is not always possible to change the address; where possible, this may involve additional costs and extend the delivery timeframe. Delivery to P.O. boxes may not be available.

Inspection and transport damage: we recommend that you check the parcel upon delivery. If you detect external damage or tampering, note this on the carrier’s delivery slip where possible and notify us within 24–48 h with photographs so we can manage the incident with the carrier. This recommendation does not limit or condition your legal guarantee rights.

Free shipping: available in mainland Spain on orders from €70, and in the Balearic Islands and mainland Portugal on orders from €90. The threshold is calculated on the value of products including VAT, after applying coupons/vouchers and before adding shipping costs. Not applicable to deliveries outside the areas indicated in this clause or to the rest of the EU. If, after a partial return, the order falls below the threshold, we may deduct from the refund the shipping cost that would have applied without the promotion (without prejudice to your legal rights). Thresholds do not apply to split shipments at the customer’s request (these may incur additional costs).

13) Right of withdrawal, returns and exceptions

Your 14-day right of withdrawal and the return procedure are governed by the Returns & Withdrawal Policy, to which these Conditions refer. Exercising the right of withdrawal (summary):

  • Timeframe: 14 calendar days from (i) the physical receipt of the good(s) by you or a third party indicated by you (other than the carrier); (ii) for orders with multiple items/deliveries, from receipt of the last item; or (iii) for digital content/services not supplied on a tangible medium, from conclusion of the contract.
  • How to notify: send us an unambiguous statement (e.g. email or form) or use the template available in the Returns Policy. We will confirm receipt of your request by email.
  • Effects of withdrawal: we will refund payments received, including standard delivery costs (where applicable), within 14 days of you notifying us of your decision. We may withhold the refund until we receive the goods or until you provide proof of return, whichever occurs first. The refund will be made by the same means of payment used, unless otherwise agreed and at no cost to you. If you used a gift card, coupons or loyalty Stitches, the adjustment will be made in accordance with clauses 7–9.
  • Return of the goods: you must send/hand over the items without undue delay and, in any event, within 14 calendar days from notifying us of withdrawal, following the instructions indicated in the Returns Policy.
    Liability for diminished value: you will only be liable for any diminished value of the goods resulting from handling other than that necessary to establish their nature, characteristics and functioning. We ask that you return the items with their original packaging, accessories and documentation where reasonably possible.

Exceptions (summary):

  • Products made to your specifications or clearly customised, and goods cut to size.
  • Digital content/service not supplied on a tangible medium, where performance/download begins with your express consent and acknowledgement of the loss of the right of withdrawal.
  • Sealed goods not suitable for return for health protection or hygiene reasons that have been unsealed after delivery.
  • Goods which, by their nature, become inseparably mixed with other items after delivery.
  • Sealed audio or video recordings, or sealed software, that have been unsealed after delivery.

Items on back-order that are not customised retain the right of withdrawal where legally applicable and no other exception applies. If a partial return affects promotions (e.g. free shipping), the order will be recalculated in accordance with clauses 12 (shipping) and 7–9 (coupons, Stitches and gift cards).

14) Legal guarantee and after-sales

Products are covered by the legal guarantee of conformity provided for under EU and Spanish consumer law. As a general rule in Spain, the legal guarantee for goods is 3 years from delivery and for digital content/services is 2 years from supply. The guarantee covers lack of conformity existing at the time of delivery/supply and applies at no cost to the consumer (including transport, labour and necessary parts).

Scope and remedies. In the event of a lack of conformity, you may choose, free of charge, repair or replacement (unless one of these is impossible or disproportionate). If the chosen remedy cannot be applied, is not performed within a reasonable time or causes you significant inconvenience, you will be entitled to a price reduction or termination of the contract (except where the lack of conformity is minor). Guarantee periods are suspended while the item is under repair or with the service centre and resume upon return; where legally applicable, the repaired or replaced component will be covered for the relevant period.

Presumptions and second-hand goods. For new goods, if the lack of conformity becomes apparent within the first 2 years from delivery, it is presumed to have existed at the time of delivery unless proven otherwise or where this presumption is incompatible with the nature of the goods or the defect. For second-hand or refurbished goods, the legal guarantee period may be agreed at 1 year provided this is expressly stated on the product page or during the purchase process.

Common exclusions. The legal guarantee does not cover deterioration resulting from normal wear and tear, improper use or use not in accordance with the instructions, impacts or accidents, unauthorised handling or repairs, lack of maintenance, contact with chemicals or washing that does not follow the manufacturer’s instructions, nor slight tone/colour differences due to screen calibration. Consumables and parts subject to wear (e.g. blades, coatings, tips/needles) are subject to their normal lifespan.

How to make a guarantee claim. Write to us at tienda[arroba]garmonyarns.com stating the order number, a description of the issue and, if possible, photographs or video. We may request that the item be inspected. If a lack of conformity is confirmed, we will provide a return label or instructions and will cover shipping costs associated with handling the guarantee. If, after inspection, a lack of conformity is not confirmed, we will offer to return the item to you; in that case, we may pass on diagnostic and return costs, subject to your prior acceptance.

Digital content/services. In addition to the 2-year period, we undertake to provide updates (including security updates) necessary to maintain conformity for as long as can reasonably be expected given the nature and purpose of the digital content, or for the period required by law.

Commercial guarantees from the manufacturer. If an item carries an additional commercial guarantee (offered by the manufacturer or by Garmon Yarns), its terms and scope will be indicated on the product page or in the accompanying documentation. This commercial guarantee is independent of and does not affect your rights under the legal guarantee.

15) Transfer of risk

The risk of loss or damage to the goods passes when the customer —or a third party designated by the customer other than the carrier— takes physical possession of the shipment, which is normally evidenced by the delivery record (signature, scan or carrier confirmation) according to the method chosen.

Exception – carrier chosen by the customer: if you decide to contract a carrier not proposed by Garmon Yarns, risk passes when the goods are handed over to that carrier.

Partial deliveries and collection points: where an order is shipped in several parcels, risk passes for each parcel at the time of its effective delivery; for collection points, risk passes when you collect the parcel and take physical possession of it.

Absence, refusal and non-collection: if you do not take possession due to absence, unjustified refusal or non-collection within the collection point’s timeframe, risk does not pass, although custody, return or re-shipping costs may arise in accordance with clause 12.

This clause does not limit your legal rights in relation to damage occurring before transfer of risk.

16) Customer service and complaints

For queries or complaints, please use the email and/or contact form indicated in clause 0. We will endeavour to respond within a reasonable timeframe and, where applicable, offer solutions in line with applicable law and our internal policies.

17) Alternative dispute resolution for consumers (ADR)

First, we invite you to contact us (tienda[arroba]garmonyarns.com or contact form) to try to resolve the matter directly. If you are not satisfied, you may turn to alternative dispute resolution (ADR) mechanisms available in your country of residence (e.g. Consumer Arbitration Boards or other accredited bodies).

Adhesion: Garmon Yarns is not generally adhered to the Consumer Arbitration System; however, we may assess, case by case, invitations from competent ADR bodies.

Cross-border EU cases: for disputes between consumers and businesses from different EU countries, you may contact the European Consumer Centre (ECC) in your country for guidance and referral to competent ADR entities.

The former European ODR platform (online dispute resolution) is closed and does not accept new claims. If needed, we will provide details of competent ADR entities according to your residence and the nature of the dispute. Using ADR does not affect your right to bring proceedings before the courts of your domicile as a consumer.

18) Force majeure

For the purposes of these Conditions, force majeure means any extraordinary event or circumstance, unforeseeable or unavoidable even with due diligence, that prevents or delays fulfilment of our obligations. By way of example and without limitation, force majeure includes:

natural disasters (earthquakes, floods, fires, storms), epidemics or pandemics and associated health measures, acts or omissions of authorities (lockdowns, regulatory changes, embargoes, customs restrictions), labour disputes not attributable to Garmon Yarns (strikes, lockouts), widespread failures of networks or telecommunications services, cyber-attacks not reasonably avoidable, interruptions to energy supply, breakdowns or accidents affecting transport infrastructure, and severe disruptions to the logistics chain or suppliers. Force majeure does not include, among other things, lack of funds or customer non-payment.

While force majeure persists, the affected obligations will be suspended and performance timeframes extended by an equivalent period, without liability for damages, provided that: (i) we notify you of the event and its impact within a reasonable time from becoming aware of it (e.g. within 72 hours), and (ii) we take reasonable mitigation measures to reduce its effects.

If the force majeure event continues beyond a significant period (e.g. 30 calendar days) or prevents delivery within legally required timeframes, we may propose alternatives (new timeframe, equivalent replacement) or, at your choice, you may terminate the contract in respect of the affected items, with a full refund of amounts paid, without prejudice to your mandatory consumer rights (e.g. withdrawal, guarantee).

19) Retention of title

Retention of title. Until full and final payment of the price, taxes, shipping costs and, where applicable, other agreed amounts has been made, ownership of the goods will remain with Garmon Yarns. Physical delivery or transfer of risk (clause 15) does not entail transfer of title.

The customer undertakes to keep the goods with due care and not to transfer, sell, pledge, encumber or alter them until payment is final, unless expressly authorised by Garmon Yarns.

In the event of non-payment, chargeback, revocation of the charge, fraud or equivalent breach, Garmon Yarns may terminate the contract in respect of the affected goods and claim their return or, alternatively, the outstanding amount, all in accordance with applicable law and without prejudice to the consumer’s mandatory rights. Recovery of the goods, where applicable, will be carried out through legal means and without unauthorised entry to your home.

This retention of title does not limit your rights of withdrawal (clause 13) or legal guarantee (clause 14). It does not apply to digital content/services.

20) Modification of the Conditions of purchase

We may update these Conditions for legal reasons (regulatory or interpretative changes), technical or operational reasons, and for business reasons (new services, logistics or pricing adjustments, etc.). Changes will not have retroactive effect on orders already confirmed and will not affect the rights acquired by the customer in respect of a purchase already concluded.

The new Conditions will apply from their publication on this page (we indicate the version date at the beginning). Where we introduce material changes that may significantly affect your rights or obligations (e.g. accepted payment methods, delivery areas, returns procedure), we will indicate this prominently on the site and, where possible, will notify registered customers or those with recent orders by email.

If any update affects an order in progress (confirmed and not yet dispatched) in an essential respect, the Conditions in force on the order confirmation date will apply, unless the change is required by mandatory law; in that case, where appropriate, we will offer reasonable alternatives (continue, adapt or cancel with a refund).

We do not publish a repository of previous versions; we recommend that you save or print the version in force at the time of your purchase (see clause 2.3).

21) Governing law and jurisdiction

These Conditions are governed by and construed in accordance with Spanish law, without prejudice to the mandatory consumer protection rules that may apply in your habitual country of residence within the EU. In the event of a dispute, as a consumer you may bring proceedings before the courts of your domicile or, if you prefer, before the Spanish courts at Garmon Yarns’ domicile. The foregoing is without prejudice to the alternative dispute resolution mechanisms set out in clause 17. If, exceptionally, the buyer is not acting as a consumer, the parties submit —with express waiver of any other jurisdiction that may correspond— to the Courts and Tribunals of Madrid (Spain), with Spanish law applying in all cases.
